This is the Privacy Policy (the “Policy”) for the website located at www.sonicsole.com and mobile apps (hereinafter, referred to as “SonicSole” and also “our”, “us”, “we”), including its sub-domains and its mobile optimized version / mobile apps (collectively, the “Site”). This Policy shall also include our Terms of Use (the “Terms”) and any supplemental guidelines and/or policies thereof (hereby incorporated by reference). All of our registered members must click on the “I Agree” checkbox on the registration form (or similar a acknowledging box or means), thereby agreeing to our Privacy Policy and Terms of Service and Use. Therefore, this Policy constitutes a legal, binding agreement SonicSole.com is firmly committed to the privacy of its members.

SonicSole.com works hard to earn and keep your trust, so it adheres to the following principles to protect your privacy:

  • SonicSole does not rent or sell your personally identifiable information (“PII”).
  • SonicSole does not disclose your contact information with other users or third parties without your consent.
  • Any PII that you provide to SonicSole will be secured with industry standard protocols and technology.

For purposes of this Policy, the Site shall be the initial point of contact between you and SonicSole, and will serve as initial point of collection of any personal data you may provide us.

The words “collect”, “use”, “process”, “treat”, “disclose” and analogous, as used herein, are related to PII and other data that we may receive from our clients, users and/or visitors, including cookies inside a computer, along with statistical and analytical complication thereof in order to create aggregate databases and marketing strategies.

Scope of this Policy

This Policy is applicable to users and visitors who enter our Site. SonicSole provides its clients, visitors and/or users with a platform designed to help people get motivated to go running, walking and jogging, using the power of music via customized running music tracks, combined with virtual coaching. We may include other Services and functionalities from time to time. Your access to the Site is only offered for your individual, non-commercial use, and not for the use or benefit of any third party you may represent.

When you register with SonicSole you voluntarily provide us with certain PII, including but not limiting to, your name, last name, IP address, email, geo location coordinates and profile picture. This data may be combined with other information collected through wearable devices or online services that you associate with our Site, including details about your exercise activities (e.g., distance, pace, heart rate, calories burned, and location). If you do not wish to disclose any PII, then your remedy is to close this web tab, delete your account and/or exit the Site. Our Site or ads do not collect any sensitive personal data about you (i.e. gender, racial origin, financial information).

Please be aware that if you post information on a public forum or bulletin board, any PII you elect to disclose therein there may or will be read, collected, or used by other users of these forums and could be used to send you unsolicited messages. All such public information shall be deemed to be non-confidential, and we (and other third parties) shall be free to reproduce, use, disclose, and distribute such information to others without limitation.

Please also note that any PII or other information you provide to be displayed in your publicly available online profile will be displayed for others to see and thus will not be subject to the terms of this Policy. We cannot and will not be responsible for what third parties do with any PII or other information that you choose to make publicly available.

Information collected, purpose and use

In order for us to perform and provide our Services to our users, clients and/or visitors, we will need to undertake the storage, use, combination, integration, disclosure, process and transfer of certain PII, either among our affiliates or other authorized third parties. We will not collect more information from you when using your social media credentials beyond the personal information such third parties disclose to us.

We may share certain anonymized, de-identified data with our affiliates, agents and business partners. This anonymized may be aggregated from our user statistics (which also do not identify you) in order to describe our services to current and prospective business partners, and to other third parties for other lawful purposes.

Location Data

Our platform includes various location-based features, used to provide our services, and will be used by SonicSole to collect, use and share precise location data of yours, including the real-time geographic location of your mobile device. For some third-party partners, such as Google, this information will be shared automatically. For others, such as and Facebook, this information will only be shared with your explicit permission or if you choose to share it via your mobile device’s settings.

Control of your information

Our users, visitors and registered members will generally be able to edit, select or delete the amount and type of PII they may disclose to us when using our Site. We continuously try to improve our user experience, and strive to provide you the best choices for the disclosure, edition or removal of your PII being processed by us, as well as to respect and enforce your right to privacy.

Safeguard of your information

We use industry standard protocols and technology to protect you registered user information and PII, such as VeriSign and Secure Socket Layer (SSL) sessions. Our Secure Socket Layer encrypts all transaction data for transmittal in a format that prevents data theft by unauthorized third parties. Parental Notice

SonicSole does not knowingly collect any kind of information from persons under the age of sixteen (16). Through the simple use of our Services and/or browse of the Site, you hereby represent and warrant that you are of legal age as of the date of first access to the Site, and, if you are still a minor (which may depend on the jurisdiction where you reside), are using the Site under the direct supervision of your parent or legal guardian.

Commercial Electronic Messages

From time to time, we will ask you for express permission and consent to receive Commercial Electronic Messages (‘CEM’), which we will sometimes send from or to computers to our users. A CEM is a message in an electronic format (e.g. emails, newsletters, SMS, social media messages, push notifications and other form of communications) which is then sent to an electronic address (e.g. email, instant message accounts, smart phone, social media profile) that contains a message asking recipients to participate in commercial activities (e.g. purchase of products and services).

Express consent for CEMs does not apply for those CEMs that we may send and that are made for security, refunds or guarantees of products and material services of our Site.

Our optional email newsletters are also considered CEMs, and therefore you may subscribe or unsubscribe from them at will, usually on your account settings, or by following the unsubscribe links contained therein.

Personal data owners’ rights

Upon receipt of your request, and after due review, we may then delete your PII from our Site.
